Journal Article 2020 03 22 In the criminal procedure law approved in 2012, useful measures have been taken in the field of execution of sentences and in the discussion of respecting the rights of convicts and convicts and monitoring prisoners. The purpose of criminal proceedings is to establish the occurrence of the crime and its attribution, the realization of the criminal responsibility of the accused, and the punishment or preventive and educational measures for the convicted person to be implemented in a timely manner so that no criminal remains unpunished and uncorrected in the society. Execution of the sentence, lack of access to the place of residence and residence of the convicted person, failure to introduce the convicted person for the execution of the sentence by a guarantor or surety, the imprisonment of the imprisoned person or obstacles of judicial origin can be mentioned as the lack of monitoring document, warning and failure to obtain appropriate security. Also, the judge rules on the implementation of corporal punishment crimes, including death penalty, corporal punishment, amputation and whipping, negative and restrictive punishment of freedom, rights and dignity, including imprisonment and exile, deprivation of residence in the border zone, and dismissal or exclusion from the country and habitation. Mandatory at a certain point or financial punishment, including fines, confiscation, repossession and destruction of property, and the case is not closed until the sentence is executed. The current research was carried out using descriptive and analytical method and relying on data from library sources. The findings of the research indicate that today there is more supervision in the field of ethics on the execution of punishment, while the judicial courts of painting schools indicate the speed of action and the legal weakness and self-centeredness of the king in the execution of punishment.<br /><br /><strong>Research aims:</strong><br />1. Examining the ethical mechanisms in the execution of punishment by the magistrate.<br />2. Analyzing how to judge and penalize in Iranian painting.<br /><br /><strong>Research questions:</strong><br />1. What ethical mechanisms are performed by the judge in the execution of punishment?<br />2. What information can be obtained from Iran's painting concerning judicial courts and execution of punishment? در قانون آیین دادرسی کیفری مصوب ۱۳۹۲ در حوزۀ اجرای احکام و در بحث رعایت حقوق محکوم‌ له و محکوم‌ علیه و نظارت بر زندانیان، اقدامات مفیدی صورت گرفته است. هدف از رسیدگی‌های کیفری، رسیدن به احراز وقوع جرم و انتساب آن، محقق بودن مسئولیت کیفری متهم و مجازات یا اقدامات تأمینی و تربیتی دربارۀ محکوم‌علیه به‌موقع اجرا گذاشته شود تا در جامعه هیچ بزهکاری مجازات ندیده و اصلاح‌نشده باقی نماند. اجرای مجازات، عدم دسترسی به محل اقامت و سکونت محکوم‌علیه، عدم معرفی محکوم‌علیه برای اجرای حکم توسط کفیل یا وثیقه‌گذار، حبس بودن محکوم‌علیه یا موانع با منشاء قضایی می‌توان عدم نظارت بر دادنامه و اخطاریه و عدم اخذ تامین مناسب را نام برد. همچنین قاضی احکام بر اجرای جرایم مجازات بدنی ازجمله مجازات سالب حیات، مجازات بدنی قطع و جرح عضو و شلاق یا مجازات سالب و محدودکنندۀ آزادی، حق و حیثیت ازجمله حبس و تبعید و محرومیت از سکونت در نوار مرزی و اخراج یا طرد از کشور و اقامت اجباری در نقطه معین یا مجازات مالی ازجمله دیه و جزای نقدی و مصادره و ضبط و معدوم کردن اموال نظارت دارد و تا حکم اجرا نشود، پرونده مختومه نمی‌گردد. پژوهش حاضر به روش توصیفی و تحلیلی  و با تکیه بر داده‌های منابع کتابخانه‌ای انجام شده است. یافته ­های پژوهش حاکی از این است که امروزه نظارت بیشتری در حوزه اخلاق بر اجرای مجازات وجود دارد درحالی‌که محکمه ­های قضایی نگارگری حاکی از سرعت عمل و ضعف قانونی و خودمحوری شاه در اجرای مجازات­ هاست.<br /><br /><strong>اهداف پژوهش:</strong><br />1. بررسی سازوکارهای اخلاقی در نحوۀ اجرای مجازات توسط قاضی.<br />2. واکاوی چگونگی قضاوت و مجازات در نگارگری ایران.<br /><br /><strong>سؤالات پژوهش:</strong><br />1. چه سازوکارهای اخلاقی از سوی قاضی در اجرای مجازت انجام می­شود؟<br />2. در نگارگری ایران چه اطلاعاتی در خصوص محاکم قضا و اجرای مجازات وجود دارد؟ https://www.sysislamicartjournal.ir/article_127446_ad6bcd8dba07e38a46f27ec234e254a4.pdf
