Examining Existing Approaches to the Relationship Between Jurisprudence (Fiqh) and Civilization in Contemporary Society (Case Study: The Jurisprudential Approach to Painting and Music)

Abstract
Various perspectives have been proposed regarding the relationship between fiqh (Islamic jurisprudence) and civilization. Some scholars deny any compatibility or connection between the two, considering fiqh solely concerned with otherworldly salvation while viewing civilization as responsible for worldly livelihood and prosperity. This study employs a descriptive-analytical method, relying on data from library sources. Conversely, many thinkers argue for the compatibility of fiqh and civilization, though with two distinct approaches: Passive Compatibility: Fiqh evolves alongside socio-economic and political developments, yet this transformation is not born from its internal discourse but rather submits to external paradigms. Also, Active Compatibility: The relationship is reciprocal—civilization can be influenced by fiqh, just as fiqh is shaped by civilization, progressing in tandem with it. This perspective asserts that fiqh can establish the necessary systems for achieving a modern Islamic civilization. Through critical analysis of these approaches, this research advocates for the second perspective—active compatibility—and proposes intra-jurisprudential (burūn-fiqhī) and extra-jurisprudential (darūn-fiqhī) methods to realize a civilization-building fiqh. The study also examines fiqh’s stance on the arts, particularly music and painting.
Research Objectives:
1.     To analyze and evaluate approaches concerning the relationship between fiqh and civilization.
2.     To investigate fiqh’s approach to music and painting.
Research Questions:
1.     What are the existing approaches to the relationship between fiqh and civilization?
2.     How does fiqh engage with the arts of music and painting?
